Ms. Hong has a plot of land for growing other annual crops and wants to change its purpose to other agricultural land to build a bird's nest house. According to Article 44 of Decree No. 102/2024/ND-CP, the conditions must be consistent with the district-level land use plan. However, Ms. Hong's case is not included in the content of the district-level land use plan. The district-level land use planning map shows the location of the plot of land as annual crop land.

The Department of Land Management, Ministry of Agriculture and Environment answers this issue as follows:

Based on the provisions of Clause 1, Article 44 of Decree No. 102/2024/ND-CP dated July 30, 2024 of the Government detailing the implementation of a number of articles of the Land Law, Ms. Hong's plot of land for growing other annual crops is not eligible to change its purpose to other agricultural land to build a bird's nest house because it is not included in the content of the district-level annual land use plan as she has presented.

Land registration is carried out in accordance with the provisions of Articles 29, 30 and 37 of Decree No. 101/2024/ND-CP dated July 29, 2024 of the Government regulating basic land survey, granting of Certificates of land use rights, ownership of assets attached to land and the Land Information System.
